Actors in pornographic movies that receive film permits from the city of Los Angeles will be required to wear condoms under an ordinance approved today by the Los Angeles City Council.
The new law was approved 9-1 today, with Councilman Mitch Englander dissenting and Councilmen Richard Alarcon, Tony Cardenas, Bernard Parks and Ed Reyes absent. The ordinance received preliminary approval last week.
The safe sex requirement was proposed by AIDS Healthcare Foundation. The group collected almost 71,000 signatures to qualify the initiative for the city ballot. Because putting the issue to the voters would cost $5.5 million for a special election or $4.4 million for the June ballot, according to the City Clerk, city council members voted to enact the ordinance as is.
The City Attorney’s Office has previously warned that the city may not have authority over the issue as workplace safety is regulated by the state. In voting against the proposal, Englander noted public health is a responsibility of Los Angeles County.
“I don’t believe the city of L.A.has authority over this issue. Public Health falls under the jurisdiction of the county, not the city. We are still waiting for a legal answer on the question of jurisdiction. At a time when our city services are so impacted, we must consider very carefully how we use our scarce resources,” Englander told The City Maven.

A representative for FilmLA tells The City Maven that while the agency does not track pornographic filming as a separate category, a manual count over a one-month period showed there were 40 permits for adult films.
